THE BECKY MIDDLETON STORY





Looks like it's not safe to travel outside the U.S. anymore. This 1996 incident just reiterates why we should boycott Aruba and most importantly be aware of your surroundings and stay alert to what is going on around you. 

Use common sense. Don't leave your group of friends. Have a plan. Keep an eye out for your friends as well. You don't have to be a 'babysitter', but as a friend, you should be wary of anyone you don't know...especially if you are a woman in another country. 

Tourist women are the number one targets in other countries.


The Brutal Torture, Gang Rape, Sodomization and Murder of Becky Middleton Rebecca

(Becky) was a Canadian tourist visitor to Bermuda, only 17 years old. She was staying with her friend Jasmine, daughter of local resident Canadian Rick Meens and his Bermudian wife.

On the night of July 3, 1996, after going to the Town of St. George to attend the Wednesday evening Harbour Night (7 to 10 pm), she and Jasmine visited the White Horse Tavern bar and restaurant. Then she and Jasmine went to the home of another friend in the town for about 45 minutes or so. At 1:16 am, more than an hour after the last bus from St. George's had left, Jasmine Meens made her first call from there to Radio Cabs. The dispatcher said a cab was on its way. Jasmine called again shortly afterward. The dispatcher said the same thing. They went outside again to await its arrival. After the third call, Jasmine became very upset, and the woman again promised. This was a little after 2:15 a.m.

Finally, in desperation, the two girls, Becky and Jasmine, believing they had no other choices, accepted an offer of a ride home from young men on motor cycles.

Jasmine arrived home safely but Becky was abducted - kidnapped - by two young men, taken to a desolate place at Ferry Reach in Bermuda, brutally stabbed and cut 35 times, beaten, tortured, gang raped repeatedly and viciously, sodomized, brutalized and murdered.

Dr. Keith Cunningham and Dr. James Johnston completed an autopsy on the mutilated body of Becky. Both discovered anal and vaginal trauma, along with some 35 cuts, five of which were fatal. Also, the Police and prison physician Dr. Henry Pearse said her body was so covered in blood that it was hard to determine her exact injuries (at the site).

He also confirmed in writing that she had been raped again and again and reported the torture wounds at the top of her head, forehead, neck and throat. It was the worst, most brutal, most animal sexually-depraved, most violent and inhuman racial murder of any woman anywhere in the world.

News of the horrific, depraved murder of Rebecca (Becky) was flashed around the world when it happened. To date, it has been a notoriously botched murder case. The British and Bermudian authorities have done nothing so far to investigate it thoroughly and bring the perpetrators to full justice at long last. Scotland Yard was not called in, the perpetrators were never charged with murder. Bermuda's Attorney General, who had conducted every other murder trial during his tenure, declined to handle the case.

Two men were arrested over Rebecca's killing. Kirk Mundy, then 21, claimed to have had consensual sex with her and blamed co-accused Justis Smith, then 17, for the killing. Before Police had completed forensic tests, prosecutors accepted Mundy's guilty plea to a charge of accessory after the fact. He was sentenced to five years behind bars.

Smith was tried in November 1998 for premeditated murder, but halfway through the trial, Supreme Court Judge Vincent Meerabux ordered jurors to acquit him, saying there was no forensic evidence such as blood or semen tying Smith to the scene. The initial investigation was handled by police officers with only limited experience in relation to murder investigations.

The entire police investigation was criticized as inadequate and prosecution decisions were condemned as inept when one man was allowed to plead guilty to a lesser charge and the other was acquitted on a questionable ruling by the trial judge.

Bermuda has not regarded it as a crime so inhumane that the killers deserved the maximum penalty. The men who raped, sodomized and racially murdered Becky have not been banned from entering Canada, the USA, the United Kingdom or Europe.

There seem to be conflicting reports on whether or not a claim was ever made to the Bermuda Government under its Criminal Injuries Compensation Board methodology, if such a claim was legally possible, or for any other compensation, for the murder, sodomy and rape of Becky in the country the World Bank has rated as the richest in the world in per capita income. (The local Criminal Injuries Compensation provision is still very low compared to other countries, even since it was increased to $100,000 - the maximum was only $70,000 when Becky was murdered, etc).

The British Government has not offered to assist in any way despite for what occured in Bermuda has a British Overseas Territory. Nor has the Canadian Government offered to assist in such a prosecution for what happened to one of its citizens. 

On April 1, 2006, The Royal Gazette reported that Bermuda's Director of Public Prosecutions (DPP) Vinette Graham-Allen ruled that Justis Smith and Kirk Mundy could not be retried on sexual assault charges "as it broke the well-established law that a man should not be twice punished for an offence arising out of the same facts."

To run sequential trials for offences on an ascending scale of gravity could be deemed an abuse of the process of the court, she argued. She said the constitution guaranteed an individual cannot be re-tried for the same offence or any other offence for which he could have been convicted at the earlier trial. It is understood permission is needed from the DPP in order for a private prosecution to take place.

The DPP said the same evidence which formed the basis for charging Mundy in 1996 would be the same evidence for launching a trial on sexual assault. “No new evidence has surfaced since his conviction, to justify the preferment of fresh charges.” New charges would amount to a breach of Mundy's constitutional rights and an abuse of the courts and powers of the DPP, said Ms Graham-Allen. She argued the same protection of the Constitution applied to Smith who had been acquitted by the Supreme Court. That decision was upheld after being reviewed by higher courts.

In the review, which looked at the record of all the evidence provided plus the legal judgments on the case, Ms Graham-Allen said Rebecca had been sexually assaulted and there was evidence that which cast doubt on Mundy's claim of consensual sex. But that should have been put before a jury as it had been available to the Crown prior to Mundy's committal to trial in November 1996. Although there was no direct evidence to suggest Smith had sexually assaulted the teen, it had still been open for the Crown to prosecute under that offence as he could have been deemed to have taken part by aiding the perpetrator.

She added: “Further forensic reports subsequently received post-committal confirms and supports the contention that the issue of consent raised by Mr. Mundy in his admission to the Police could have been refuted.” If the DPP did launch a new prosecution the pair had ripe grounds to claim an abuse of the process on grounds of delay and pre-trial publicity, said Ms Graham-Allen.

Vinette Graham-Allen came to Bermuda from Jamaica in 2000 to take up the post of senior crown counsel and was promoted to principal crown counsel later. She became Director of Public Prosecutions in May 2004. Mrs. Graham-Allen had earlier stated that her ultimate goal is to prosecute war criminals in The Hague.

In distinct contrast to what has not happened in Bermuda: The government of Thailand acted quickly and decisively to prosecute to the fullest two Thai fishermen who in late 2005 raped and murdered a British tourist. In early 2006, they were sentenced to death. The Thai government apologized to the world and promised it would respond appropriately to the shocking crime. By doing so, it has kept its word and its actions help protect its tourism industry.

On March 20, 2006 in London, it was announced that a teenager who murdered a schoolgirl by knifing her through the heart at a party will serve a minimum of 14 years in prison. The Old Bailey was told Beatriz Martins-Paes took two knives to the birthday celebration in east London. She plunged one of them into Charlotte Polius, 15, after a petty incident on the dance floor.

On April 1, 2006 in London, it was announced that Thomas Waddell, 19, who raped and murdered 34 year old Farah Noor Adams, a mother power-walking along a popular riverside park in Glasgow, Scotland, was sentenced to at least 16 years in prison.

On April 11, 2006, rapist Robert Greens, 28, who on May 15, 2005 carried out a brutal sex attack on a 19 year old Dutch student near the Rosslyn Chapel, Scotland - made famous by the novel the Da Vinci Code - was jailed for 10 years by the High Court in Edinburgh, Scotland.. In mid-April 2006, the case was thrust into the US national television spotlight. Prime-time Fox News crime show On The Record – hosted by leading presenter Greta Van Susteren – examined the heavily criticised investigation into Rebecca’s death and why no one has been convicted of her murder.

The TV program examined the way prosecutors handled the case against two men who were arrested over the killing, Justis Smith and Kirk Mundy and why, in 1996, before Police had completed forensic tests, prosecutors accepted Mundy’s guilty plea to a charge of accessory after the fact. He was sentenced to five years behind bars.

Smith was acquitted of a murder charge in November 1998 after Supreme Court judge Vincent Meerabux ruled there was no case to answer. That decision was branded “astonishing” by London’s Privy Council.

Good afternoon,
My children and I lived in Bermuda at the time and the whole population of Bermuda was under utter shock. The children were terrified and checked the doors several times before we went to sleep at night. Bermuda being such a small intertwined community makes it difficult to stand up for what you believe in.
This is unbelievable and until today, I cry over Rebecca. It just confirms that anything can happen and if such an obvious crime goes unpunished what cannot happen.
I feel so very deeply for a family that will probably never be able to grieve in peace, tortured by so much horror from such a "nicely groomed" environment. But believe my experience, there are some wonderful loving people in Bermuda but there are also some deprived nasty souls and they are not the ordinary common people they are sometimes in the tops of tops of glamourous well thinking Bermuda personae, wearing a mask of honesty hiding their true nature.

As a tourist visiting Bermuda in the summer of 2003, I was raped in Hamilton. The police treated me as though I had committed the crime. It was humiliating and horrifying. I am fortunate to have lived through the ordeal and my heart goes out to the family of Rebecca Middleton. The incompetence of the Bermudian athorities is blatant and repugnant. It is a tragedy that this information is kept secret enough for people to unknowingly send their daughters on vacation to a place we are not valued or kept safe from harm. I am quite certain my rapist is still walking freely around Bermuda as the police there did little or nothing to persue him. Perhaps one day reform will come and there will be justice for Miss Middleton. In the meanntime on a very small island filled with unsuspecting tourists (many of them young girls exposed to alcohol) there are at the very least three brutal rapists roaming free to repeat their crimes (and as sexual deviants often do) are likely to do so. I share this information in hopes that perhaps one more person will decide to vacation elsewhere. Bermuda is dangerous.

My sister was brutally attacked while in Bermuda and I can think of four or five more who I have heard of which this has happened to. While I understand that criminal deviants exist everywhere what seems apparent to me is that there is no fear of the local authourities as penalties are not inflicted because of a totally inadequate criminal justice system. The locals seem to accept it as the norm and there is a general fear of these deviants which I would hope that there are a few in a sea of many.....To date I can think of many people who will tell persons not go to Bermuda!

My heart goes out to the Parents family and friends of Rebecca and to the girls who say they have been attacked in Bermuda, I am a Londoner and live in London and have lived and worked on the Islands I would just like to say that the law in the UK has changed and therefore the law in Bermuda has as well the courts now allow for a second prosecution of a defendant in serious cases where new eviedence is available this means no double jepardy I only hope that if it is the wish of rebecca's parents that the authorities go after that pair of scumbags

I appreciate the attention to these heinous events around the world but was offended by some of your word choice. Suggesting that this is "the worst", or "most violent", or "most racially motivated", etc. diminishes the experience of rape for every other victim. Some crimes are worse than others, yes. But when discussing rape, I believe women would agree suggesting Rebecca's death is any worse than the gang rapes in the Sudan, the ones happening everyday in the US, or anywhere in the world is insensitive. Be wary of your word choice.

When a Judge allows a criminal to escape, he is putting more young women at risk and maybe if his daughter was the victim, the judge would have acted differently. The goo dfar outnumber the bad, and when you have a chance to take one of the rapists off the street, and it is not done, that is a crime too. His judgement will be done but only by our creator. Sad that others will be at risk in the meantime. Shame on you Judge Vincent Meerabux!!!!!!

I have a 3 year old son and I'm scared for when he is older, this world is a horrible place to live these days as a young woman myself I have already been attacked a few times and escaped an attempted rape I just count myself lucky, but I pray for all who have been a victom of crime may you all rest in piece or survive strong and the attackers rot in hell! I lived in Bermuda for many years and still remember this terrible murder taking place. My heart goes out to the family and I just hope that some day soon the people who committed this terrible crime will be found guilty and made to pay.

My family wanted to plan a trip to Bermuda for our annual family vacation (2011). Accordingly, I started doing research on Bermuda and ran across this website. I do not need to research any further. No way am I taking my family to a place where rapists and murderes run free. Further, I'm not giving my hard earned dollars to a country and it's people who can't bother to stand up with some spine and convict criminals. If there is no justice then crims is rapant as far as I am concerned. IT only takes one.

Hi I am a Bermudian I have lived in bermuda all my life. When rebecca was raped I was about 5 years old. I don't remember the rape but I have heard about it. I feel real offend by these comments. Bermuda is not a dangerous islnad. yes our police are eff'd up and come on a call only when wanted but saying we are a dangerous place is uncalled for. Kirk Munday on this date exactly is behind bars! My condolences go out to the Middleton Family.

What matters about the whole message is that a beaufiful young lady was brutally raped and murdered. I personally knew Becky. What happen't to her was COMPLETELY BRUTAL and no one, NO ONE, should have to endure what she did! What if this was your daughter, or your sister, or your mother, or your wife wife, or your friend. Think about things before you say them. If someone wants to make a comment about the place that it happen't...THEN LET THEM!

Well, I'm so saddened by this event.. even 16 years later. Now Bermuda is facing the harvest of it's sewing.... Justis Smith has been charged with home invasion. Bermuda deserves the disrespect it gets. The whole world should boycott Bermuda until the correct punishment be issued.

I am in now way trying to down play what has happened or the attacks on tourist mentioned, but I think that when people come to Bermuda, they think and act as if they have entered heaven. On vacation anywhere in the world this can happen. You should be on your guard anywhere and have a designated person or have a buddy that you travel with at all times. And not get so inebriated that you can't defend yourself or make good decisions. Never anywhere even in my home, Bermuda, am I going to get into a car or on a bike with strangers. Never am I going to walk through a dark alley or behind a building alone. And if I have to I will be on alert with my phone out and my keys in hand to at least try to defend myself. Things like this happen in Canada, they happen in the states, they sure as hell have happened in Mexico with students going for spring break. So don't go anywhere in the world thinking oh nothing can happen to me here. Make good decisions. Anything can happen to you anywhere. I'm not saying it's not smith and mundy's fault. It is!!! And I would never be able to look them in the face let alone be around them if I ever met them. But for future reference to all. To anyone going on vacation anywhere or even when your home. Make smart decisions. Be safe. Don't think that because you are in a comfortable environment or because everyone seems so nice and welcoming that nothing can happen. There are sick deranged people everywhere. Be aware of that fact!

And I believe that Bermuda authorities definitely handled the case sloppily and should find a way to rectify the matter. But that probably won't happen. The Bermuda government has been a mess for a long time. And until something changes it will continue to be.

How long will this go on? I have had a family member killed in Bermuda brutally as well, but I have learned that vengeance is the Lord's. Those that did this evil to that young girl will have to pay the price for their actions. It is not Bermuda that killed her, it was two sick people who could tear a body apart so cruelly and stomach it. I could not do it. Sick minds did this, not Bermuda, so I am asking her parents to heal. You are holding on to so much anger and hurt, and I understand, but I think that you could make something positive out of this. Education for teenagers about protection for themselves. We know you visit Europe and people prey on people and place them, against their will, into the sex slave trade. Bermuda is still a beautiful Island, but you have to educate yourselves that they still have to protect themselves. Make sure your children are comfortable to call on you know matter where they find themselves and what position they find themselves in. Again I sympathize with the family, but let her rest in peace.

I am not saying she deserved to die, she really didn't deserve this, but all this is not bringing her back, and there is no way we can get justice. What happened to Becky was horrible but what I have never been able to understand is this:
Why were underaged girls allowed to go out drinking alone? What kind of person did Becky's parents trust to care for her who would allow her to go out and get drunk underage.
When the Taxi never showed up, why didn't the girls call the Rick Meens to come and get them rather than get rides with complete strangers? I am sure they have been told not to take rides from strangers
Why wasn't Rick Meens out looking for the girls after Midnight given they were underage and in his care?
There was a Police Station right in St. Georges.....why not go there for help rather than get a ride from strangers?

They chose to stop--and prey on Becky like animals. I am sure Mr Meens felt responsible to some extent, just as I would if she had been my guest. But the facts are that they called for a taxi three times and it didn't turn up. I live in Bermuda I have had that experience myself and I know it is very common. Why don't you blame the taxi company/driver, rather than Mr Meens? I'm just making a point that this is as out of place a question as the ones you are proposing.
In any case - yes, the girls made what proved to be a very bad decision, I am sure based on the fact that Bermuda "is a safe place with very low violent crime where nothing ever happens..."
The point that you are missing, is that this is not about trying the girls, their parents or their host, it is about the LACK OF JUSTICE when Bermuda's system failed completely to do its job and let one of the murderers free and the other one get away with a 5 year sentence in spite of having circumstantial and hard evidence on both of them.

I was searching to find out what happened with the appeal to the European Court of Human Rights, as the last reference I could find on it was from years ago that it was still pending consideration 4 years after being filed. Has it now been accepted or rejected or is it still pending evaluation?

I find this whole thing truly sad. I find the fact that this happened sad. I find the fact that people are placing blame and judging an island truly sad when it can be argued that the "what ifs" and " should haves" are tremendous. From stranger danger to taxii service to law enforcement etc.. I find it sad that people are placing a label on this island and forget that this event not only horrified foreigners but Bermudas own people. Bermudians had a sense of safety and this situation took that away. Do you forget there are human beings with families on the island? With teenage daughters? Also, Bermudians will say that these things happen all over the world. Not to downplay it, but to just say no matter where you go, possibly you will be faced with danger so to write off one island is ridiculous. Write off every place on this earth that has a history of violence including possibly the place you were born and raised(wherever that is). Can we get some crime statistics from back during that year into the equation and compare it with neighborhoods and areas around the world? This only comes into play because people are labeling the island so yes...it is relevant. It needs to be considered. It doesn't take away from how horrible this is or the fact justice should be served. Honestly there are too many ignorant comments on both sides of the fence. This shouldn't have happened period. She deserves justice period. There is no way of sweeping this under the carpet...it happened.. so any Bermudian who is like let's move on... cut it out and keep that opinion to yourself. It's horrible make it so we have learned enough and have been informed enough that the past "should haves" are less likely to reoccur (on all parts- traveling tourists- judicial system etc). When possible...make sure justice happens and stop cursing the island. Nowhere is perfect and this is a very unfortunate reminder of that.

I have read and absorbed everyone's comments....some are extreme and others qualified. I have been visiting Bermuda since 2008 on my Honeymoon and then every year since on holidays and was aware of this vile crime but not the details. I have felt completely safe on this island more so than my own country at times. It is not the Island or the Islanders that should be abused in this forum but the government and the sick perpetrators....I am aware that the Bermudian government has recently had a shake up and a new PM is in power. lets hope he will re-open this case and the Middleton family will receive their justice. Stop verbally abusing people on this forum. Use your energy to petition the Bermudian Government to have the case re-opened and let her family finally grieve in peace.
When I visited once we had looked at Foder's guide to find new restaurants and bars to eat. When we asked a Taxi driver to take us to a particular bar which had been rated in Foder's they refused to take my husband and I because it had recently had problems and the Taxi driver (although it was a good fare) was more concerned about our welfare than getting money out of tourists...so please be careful when you decide to tar everyone with the same brush...it simply isn't true. We all need to learn from these terrible crimes from victim and family support to better policing and laws safeguarding victims and their families and make our families aware that they need to be vigilant EVERYWHERE!!!!!

I agree that the legal system needs to be updated and rid of people who are being paid to do a job they hav no experiance doing.a horrendous crime commited and if it was my child I would never ever giv up until justice was done god knows dem two people who commited dis act will be punished in dew time but I guess dat is little comfort to her parents as she is no longer alive may she rest in peace!! And until burmuda accepts and acts on future crimes appropriatly I would not go there for no love or money that girls murder is on their concience hope all those people involved in da case sleep good at nite!!!!!!

I never knew dis girl or her family but I feel so bad for them I hope they get the closure they deserve after so long. I was once told by my father that it is better keep my mouth shut and be thought a fool, then to open it and prove it. If you have no idea of what you are talking about, one should not make any comments. There are some facts that have been left out. The police rushed to prosecute, but that was at the insistence of the Canadian government to bring someone to justice. The police themselves wanted to wait, but the prosecutor was getting a lot of heat from the representatives of the Canadian government. In retrospect that was a mistake, but if everyone had let things take their natural course then there would have been a proper prosecution and there would have been convictions. Instead as always politics gets involved and screws up everything. Secondly, when the DNA results came back they did not find Justis Smith's DNA anywhere on or near Rebecca Middleton. That is why they had to let him go as there was no direct evidence to connect him to the rape and murder. Secondly, almost everyone connected with or who had anything to do with this case was not Bermudian. The rapist and murderer was from Jamaica. The prosecutor was from Barbados, The judge, the police commissioner and the lead investigators were all from the UK. On another note, yes the US punish their criminals, but how many people are in US prisons who did not commit the offence for which they are in prison. As Sir William Blackstone stated "It is better that 10 guilty man go free than for 1 innocent man be sent to prison. Apparently, the US does not subscribe to this principle.

What that poor girl must have went through is so sad. I myself was attacked and nearly raped and murdered. I fought for an hour to stay alive and even pnsi in NI were i live did nothing. But i lived. Poor rebbeca didnt get the chance to live. She died a terrible death. Its upset me. I hope them scumbags rot in hell. And my heart goes out to her parents. Im so sorry for your loss. My heart goes out to the family, First for having to go through the brutal death of their daughter and then being re-victimized by a country and its judicial system for so many years who did nothing to get a conviction or give restitution to the family. I say tourists should boycott Bermuda until this case is reopened and dealt with correctly. Yes every country has crime, but one expects and should receive assistance from the police, judicial system, and local government when any crime is committed, instead of having to deal with what amounts to be a bunch of bumbling idiots. Also, when those in charge of running the country and judicial system do absolutely nothing to properly investigate and convict the criminals then they are just as guilty as those who perpetrated the crime. SHAME. I don't blame the people of Bermuda but pressure must be placed on the government to reopen this case and the only way to do so is to hit them in the pocket book. Words just fall on deaf ears. Bermudians should also put pressure on their own government to act responsibly. If this happens to foreigners what happens to the Bermudian people? As a retired Florida Deputy Sheriff and State cop I am appalled at the corruption and incompetence of the Bermuda Criminal Justice system. I watched a repeat of a popular crime show featuring this case. There is no way I can call the person who ruled that there was not enough evidence in this case a Judge. If this case had been tried by an illiterate homeless man here in Florida both of these two animals would have gotten lethal injection. We don't mess around here with rape and torture murders of little girls. There is NO WAY that anyone can convince me that this so called "judge" wasn't paid off [ what we call payola here]. This man should be disbarred for incompetence and if after a proper investigation probable cause [payola] is determined, jailed.
To call the Bermuda Police of that era Police Officers is a total insult to my proud profession.Ditto for the so called prosecutor who made that idiotic deal with one of the scum. Must have an IQ of 5.

What I am wondering is why Jasmine's father would allow 2 underage girls to go to a bar with no adult supervision in a foreign land. He was responsible for the girls going out alone and indirectly, for the consequences.What did they do after they left the bar? I am a female, born and raised in Bermuda, and I am ASHAMED TO BE CALLED BERMUDIAN. What happened to Rebecca was vile; the handling of the case was vile; those two monstrous, murderous, cowards are vile; the ONLY thing not vile was the precious, innocent life of Rebecca. It is now 20 years later since those animals committed such a vile act, and it hits me now more than ever because 20 years later I am the mother of a beautiful teenage daughter, and the thought of what Rebecca went through and what her parents have had to go through pains me so deeply to the point of tears. All I can say is I believe that Rebecca's beautiful spirit is at peace and in the light. I also believe in karma, so whether in this life or the next, everything will come full circle. Bermuda, pop 60,000 is like an annexe of Maidstone, Kent where I live - we have 2 senior Conservative Politicians in Maidstone who lived and worked in Bermuda. Many Bermuda Police are British who came to Maidstone for their training at Kent Police HQ. I was set up by someone working for a Maidstone private medical business, BMI Healthcare, to visit Bermuda for my health. I am still alive, but the intention was to rape and murder me in Bermuda aided by my hotel, Sonesta Beach Hotel and Carlton Adams of the Bermuda Police. The Sonesta Beach Hotel arranged for a taxi on 10.3.2001 to take me to the airport for the flight home. Vernon Harrison was the taxi driver, he abducted me and took me to John Smith's Beach. It would be a good thing if you read ALL OF THE FACTS of the case. Had the Canadian government not gotten involved and allowed the DNA evidence to be tested and analyzed, then perhaps justice would have prevailed. So do not comment topics which you have NO DIRECT and reliable information.
